Philadelphia Class-Action Suit Over Webcam Spying in Jeopardy
Class action lawsuits in Philadelphia and throughout the state may be utilized to enhance the efficiency and effectiveness of a court’s proceedings when large groups of individuals with similar claims of injury or violation collectively file one lawsuit. In several situations, if it is decided that one or more of the distressed individuals will speak for the affected group in court, and if those delegates fulfill certain criteria, then they may be given the chance to prove and settle claims on a collective and individual basis.
A recent Philadelphia Region Local News article reports that a class-action lawsuit may be abandoned by a family seeking damages from a suburban Philadelphia school district for alleged webcam spying. In a relatively atypical situation, the family has been given until June 7 to pursue a class-action suit.
Apparently, the determining factor seems to be that if affected families of this supposed webcam spying have access to webcam images and secretive screen shots from student computers, then families will have the information they need to file individual lawsuits rather than pursuing class-action. Due to financial reasons, and perhaps to keep their young children out of media attention, hundreds of parents within the Lower Merion area are against filing a Philadelphia class-action lawsuit; however, it remains unclear at this time what the final choice will be.
Why would a Philly class-action lawsuit be necessary for this particular predicament? It has been noted that the school district admits to having taken over 50,000 screen shots and images from webcams on students’ computers. In defending what has outraged hundreds of trusting and concerned parents, the district claims that the photos and images were taken in a “misguided effort” to establish the location of computers that were provided to students for use.
Class-action lawsuits in Philadelphia are highly complex and are best handled by the most experienced Philadelphia class action lawsuit attorney. These cases typically involve prominent businesses, manufacturing companies, government entities, or school districts, that have imposed wide-reaching harm or negative affects upon a large group of people. While these types of lawsuits can greatly benefit a group in their pursuit of justice, some situations may not be suitable, nor qualify, for class-action status.
